Abstract

This article points to the analysis of the sources of rights and the relation with the problem of the efectivation of humain rights, in the domain of the general theory of law. When the law do not answer any more to the social problems, what can the judge make to answer to the society that inquiry for justice? Can the judge be active in the creative production of law? This questions, and many others, are touched in the contexte of this article
