Abstract

الفکر المقاصدي عند الإمام الجويني في السياسة المالية خالد فالح العتيبي قسم الفقه والأصول کلية الشريعة جامعة الکويت, الکويت , الکويت. البريد الالکتروني: Dr_khaled_faleh@ku.edu.kw الملخص: تناولت في هذا البحث الفکر المقاصدي عند الإمام الجويني، والذي بناه على استقراء النصوص الشرعية، مما سطره في کتبه الأصولية، والتي احتوت على العديد من التعابير الدالة على المقاصد الشرعية، مع التنوع في القوالب التي صاغ فيها هذه الألفاظ والعبارات المقاصدية، التي ربطها بالتطبيق العملي، حيث أعمل مقاصد الشريعة في السياسة المالية للدولة، فأوجب ادخار فائض الأموال التي ترد إلى خزينة الدولة، بل وتنويع مصادر الدخل العام للدولة، وأن الإنفاق العام للدولة ليس على عواهنه بل له مصارف محددة ومعلومة جهة وقدرا، فبين في هذه المسائل أن للمقاصد الشرعية دورا في حفظ ورعاية مصالح الأمة الدينية والدنيوية من الضرر اللاحق بها.           Imam Al-Juwayni Islamic Jurisprudence Objective (Maqāṣidia) on Fiscal Policy.     Khaled Faleh Al-Otaibi Department of Jurisprudence and Origins Faculty of Sharia,  Kuwait University, Kuwait, Kuwait. E-mail: Dr_khaled_faleh@ku.edu.kw   Abstract: This research addresses the Islamic jurisprudence objectives of Imam Al-Juwayni, the Imam formed his understanding from the inductive reading of the texts, that clearly appears in his authored Islamic jurisprudence books, these books encompassed in many contexts using various terminology and sentences which refer to the Islamic jurisprudence objectives, the Imam relates those objectives with practical application. Among these applications is the State fiscal policy in his theory he made it obligatory to save the surplus of the funds of the State treasury, to diversify the sources of income of the State, and that public spending shall not be arbitrary, rather, shall be firmly specified in terms of the amount and the aspect of spending. Accordingly, the Imam shows in these issues that Islamic jurisprudence objectives play a crucial role in saving the interests of the nation whether that concern the daily life of people or the religious interest and to avoid any potential negative affect     Keywords: Thought, Purposes, Sharia, Imam Al-Juwayni, Fiscal Policy.
