Vaksman","doi":"10.21564/2225-6555.2021.2.239908","DOIUrl":null,"url":null,"abstract":"For the first time in Ukraine, the definition of «political advertising» is reflected in the Law of Ukraine «On Elections of People’s Deputies», so far only on the basis of the definition of «advertising» in the Law of Ukraine «On Advertising» it was possible to qualify political advertising as any information about political actors, political parties, designed to raise awareness of their activities.\nThe mechanism of legal regulation of political advertising involves the development and adoption of national laws and regulations governing public relations arising in the process of production, placement, distribution of political advertising, because in this case may affect the interests of society and the state as a whole.\nToday the issue of political advertising is regulated by several legal acts, in particular in Article 1 of the Law of Ukraine «On Advertising» provides only the definition of such advertising without details, the Law of Ukraine «On Local Elections», the Law of Ukraine «On Elections of Deputies of Ukraine», the Electoral Code Ukraine’s norms stipulate the peculiarities of campaigning in the form of political advertising, some restrictions on campaigning, etc. Therefore, the legislation should be characterized by the dispersion of norms on such advertising and inconsistency in the definition of «campaigning» and «political advertising.\nTherefore, it is suggested to get acquainted in detail with such a phenomenon as political advertising. Abstract

For the first time in Ukraine, the definition of «political advertising» is reflected in the Law of Ukraine «On Elections of People’s Deputies», so far only on the basis of the definition of «advertising» in the Law of Ukraine «On Advertising» it was possible to qualify political advertising as any information about political actors, political parties, designed to raise awareness of their activities. 政治广告法律规制的若干问题
在乌克兰,“政治广告”的定义首次体现在乌克兰《人民代表选举法》中,到目前为止,只有在乌克兰《广告法》中对“广告”的定义的基础上,才有可能将政治广告定义为旨在提高人们对政治行为者、政党活动的认识的任何信息。政治广告的法律规制机制是指制定和采用国家法律法规来规制政治广告在制作、投放、发行过程中产生的公共关系,因为在这种情况下,可能会影响到整个社会和国家的利益。今天,政治广告问题受到几项法律的规范,特别是乌克兰《广告法》第1条只规定了这种广告的定义,而没有详细规定,乌克兰《地方选举法》,乌克兰《乌克兰代表选举法》,乌克兰选举法的规范规定了政治广告形式的竞选活动的特点,对竞选活动的一些限制,等等。因此,立法的特点应该是关于这类广告的规范分散,以及“竞选”和“政治广告”的定义不一致。因此,建议详细了解政治广告这一现象。本文着重分析了文献中存在的不同界定“政治广告”的方法及其本质,考虑了“政治广告”与“竞选活动”的区别,并分析了现行立法和对这类广告的法律规制现状
