The author's viewThe Supreme Court of Victoria is prepared to scrutinise whether, in exercising its discretion, real and genuine consideration was provided by the trustee by way of it informing itself about the various circumstances of beneficiaries and will order the removal of a trustee where its discretion had not been exercised upon real and genuine consideration. Tesi La Corte Suprema dello stato australiano di Victoria ritiene di dovere valutare se il trustee, dovendo esercitare la propria discrezionalità, si è informato circa le condizioni dei beneficiari e ordina la rimozione del trustee che non ha esercitato un potere discrezionale sulla base di considerazioni attinenti alla realtà e non influenzate da conflitti.
