Abstract

Допрос является одним из важнейших следственных действий, которое проводится с целью получения показаний от участников уголовного процесса. Допрос свидетелей и потерпевших по любой категории уголовных дел сложно переоценить, поскольку получаемые в процессе допроса показания могут иметь существенное значение в процессе доказывания. В статье рассматриваются проблемы тактики допроса свидетелей и потерпевших, проводимого в условиях бесконфликтной ситуации. Значение такого следственного действия, как допрос, в процессе собирания доказательств по уголовному делу велико. Очень важно получить от допрашиваемых объективно-правдивые показания. Однако не всегда это возможно в силу различных объективных и субъективных причин, поскольку показания основаны на процессе запоминания и последующего воспроизведения фактов, событий и обстоятельств. В работе нашли свое отражение вопросы, которые помогут должностному лицу, осуществляющему предварительное расследование, собирать доказательства с помощью электронно-цифровых следов, оставленных допрашиваемыми, для получения объективных сведений об их деятельности до, в момент и после совершения преступлений. Таким образом, применение электронно-цифровых следов, зафиксированных рассмотренным образом, в раскрытии, расследовании и предупреждении преступлений имеет важное значение и будет способствовать более эффективной борьбе с преступностью во всех ее проявлениях. Interrogation is one of the most important investigative actions that is carried out in order to obtain evidence from participants in the criminal process. It is difficult to overestimate the interrogation of witnesses and victims in any category of criminal cases, since the testimony obtained during the interrogation can be of significant importance in the process of proof. The article deals with the problems of tactics of interrogation of witnesses and victims conducted in a conflict-free situation. The significance of interrogation in the process of collecting evidence in a criminal case is high. It is very important to obtain objective and truthful testimony from the interrogated. However, this is not always possible due to various objective and subjective reasons, since the testimony is based on the process of memorizing and subsequent reproduction of facts, events and circumstances. The article reflects the issues that will help the official conducting the preliminary investigation to collect evidence using electronic digital traces left by the interrogated to obtain objective information about their activities before, during and after the commission of crimes. Thus, the use of electronic digital traces recorded in the considered way in the detection, investigation and prevention of crimes is important and will contribute to a more effective fight against crime in all its manifestations.
