Derecho Constitucional Consuetudinario y Acto Constituyente

Abstract

Resumen Este es el capitulo de un trabajo mas ambicioso, me propongo senalar de que manera el proceso consuetudinario de creacion de normas afecta el establecimiento, modificacion o substitucion de la constitucion (y, en general, de cualquier legislacion), con objeto de determinar el papel que juegan la consuetudo y la eficacia en estos procesos. En otras palabras, intento probar de forma plausible como se establece una constitucion (material) y cuales son las relaciones que guarda con el documento denominado: “constitucion escrita”. Abstract  This is the chapter of a more ambitious work, I intend to point out how the customary process of creating standards affects the establishment, modification or substitution of the constitution (and, in general, of any legislation), in order to determine the role who play consuetudo and effectiveness in these processes. In other words, I try to prove plausibly how a constitution is established (material) and what are the relationships it has with the document called: “written constitution”.
