Dual-Track Federalism: State System of Austria-Hungary as an Attempt to Transition From Empire to Early European Integration

Abstract

— The authors of the article examine the state system of Austria-Hungary, which can be described as dual federalism and described as an attempt to transition from the Empire to early European integration. The study of Austro-Hungarian statehood shows that the existence of well-developed legal norms does not ensure the success of the integration project if the legislator does not find effective legal procedures for resolving conflicts such as the federation's interference in the affairs of its subjects, the actual assignment of powers by the federation to the subjects, and the assignment of powers by the subjects of the federation to the federation.
