التعارض عند الأصولیین حقیقته وطُرق دفعه

Abstract

يتناول هذا البحث مسألة من المسائل المهمة في علم أصول الفقه، وهذه المسألة تتعلق بباب من الأبواب المهمة في هذا العلم، وهو باب التعارض والترجيح، تناولت فيه حقيقة التعارض عند الأصوليين، ومجاله، وأنواعه، وشروطه، وطرق دفعه. وقد جاء هذا البحث في مقدمة، وأربعة مباحث، وخاتمة، بينت في المقدمة أهمية الموضوع، وأهدافه، وخطته، وجاء المبحث الأول في تعريف التعارض في اللغة والاصطلاح، وأهميته، والمبحث الثاني: في مجال التعارض، وأنواعه، والمبحث الثالث: في شروط التعارض، والمبحث الرابع: طرق دفع التعارض. وفي الخاتمة: بينت أهم النتائج التي توصلت إليها، ومنها: أن التعارض هو تقابل الحجتين المتساويتين على وجه يوجب کل واحد منهما ضد ما يوجبه الآخر، في محل واحد، وفي وقت واحد، وأن العلماء اختلفوا بين التوسع والتضييق في محل التعارض، وأن التعارض لا يتصور حقيقة بين الأدلة القطعية وهو قول الجمهور، وأن من شروط التعارض تضاد الدليلين، وتساويهما من حيث القوة وأن يکونا في محل واحد، وفي وقت واحد، وأن العلماء متفقين على طرق دفع التعارض إلا أنهم اختلفوا في ترتيبها، وعند وقوع التعارض وعدم الدليل فإنه يصار إلى الجمع فإن تعذر يصار إلى الترجيح، فإن تعذر فإنه يصار إلى النسخ، فإن تعذر يصار إلى التساقط، وترک العمل بالدليلين، وهو قول الجمهور.   This research deals with an important issue in the science of usul al-fiqh, and this issue relates to one of the important chapters in this science, which is the topic of contradiction and preponderance, in which I dealt with the reality of contradiction among the fundamentalists, its scope, types, conditions, and methods of payment.
