Abstract

The research concern is to answer the following question: Does the court have the authority to appoint and remove the deads' guardian in the Saudi law? One of the objectives of the research: the definition of the deads' guardian, to clarify the conditions, and to know the limits of the court's authority in the appointment and dismissal of the deads' guardian, this research has been organized in two sections: I stated in the first section about the authority of the court in the appointment of the deads' guardian and dealt in this section the appointment of a deads' guardian or more when necessary, and the appointment of an assistant to the deads' guardian, and determining the powers of the deads' guardians, in addition to considering the request of the guardian reward or remuneration on deads' guardianship, and consider the continuation of deads' guardianship.The second section talked about the authority of the court to dismiss the guardian and the impact of the failure of one of the conditions to be met by the deads' guardian, and the rule of default of the guardian duties of guardianship or inability to do so, and the requirement of interest to remove the deads' guardian, and considering the request of the deads' guardian to step down
