Abstract

Abstract The German Federal Cartel Office’s (FCO) proceedings against Facebook have made big waves. The FCO used antitrust instruments, but based its action on a violation of data protection regulations. This action could serve as a blueprint for the violation of other non-competitive regulations, such as the violation of sustainability and environmental goals. This paper explores whether and how specifically Article 102 TFEU can serve in implementing sustainability and environmental considerations.
