Caso Boate Kiss: lições de um maxiprocesso criminal

Abstract

The paper is the result of a research project dedicated to investigating the criminal maxi-trials phenomena in the Brazilian reality. Its first objective is to check if the Boate Kiss Case fits into this phenomenon, considering the different definitions found in literature. The second objective is to analyze the innovations and problems that occurred during the trial proceedings, leading up to the conviction on December 10th, 2021. As for the methodology, the research adheres to a qualitative approach of applied nature, with an explanatory purpose, and employs bibliographical, documentary and case study methods. The theoretical discussion aims to ascertain whether the Boate Kiss Case qualifies as a criminal maxi-trial. In conclusion, it is pointed out that this case aligns with the concept of a criminal maxi-trial, and legislative changes to better regulate maxi-trials according to the requirements of an expedited and fair criminal proceeding are needed.
