El derecho islámico en Argelia: el fiqh clásico y su regulación en el ordenamiento jurídico argelino contemporáneo

Abstract

It is often said that classical schools of thought have influenced Muslim states with regard to contemporary legislation. And this influence is more visible in matters regarding family law. However, have Algerians succeeded in enforcing Quranic principles through their current legislation? Bearing in mind such question, this paper will study the institution of marriage according to Quranic and classical f iqh principles as opposed to those present in modern Algerian family code.
