Abstract
The Article is dedicated to the study of research problem
regarding human organs. Taking organs from human is of particular
importance as a form of “using human beings”. However, it is a
fundamental component of such a complex and serious crime as the
illegal circulation of those organs (human organ, body part, tissues
and cells); which is being characterized not only by a higher degree
of public danger, but also is more hidden crime (latent) in terms of
disclosure.
In this context, the author believes that in the conditions of rapid
growth of information infrastructures and biomedicine, as well as
active improvement of modern technologies, there is a need to create
a doctrine of international law in the framework of the relationship
between humanitarianism and crime, which is related to considering
the taking of human organs for transplantation as a component of
humanitarianism, and trafficking in human organs as an object of
transplant commercialism.
