Presencia del Código Napoleón en el Perú: los conflictos entre tradición y modernización

Abstract

The author, after an explanation of the first intents of codification occurred in Peru, in which he emphatizes the personality of Manuel Vidaurre, deals with the civil code of 1852, in which he observes a resistance to the change and a persitence of traditional elements such as property, slavery, marriage, divorce and the clerymen status. Then an outline is produced of the diffusion and importance of the Code Napoleon in Peru, comparting its dispositions to those of the peruvian Code, although by the fact of not being clear and determined the modernizing project, a pretty amount of defiance was born in the own sectors that lead its establishment.
